General Terms and Conditions
This is an informative translation. The legally binding version is the Czech one, governed by the law of the Czech Republic.
1) Operator and introduction
The operator of the Mapino platform and the contracting party for paid services is Nolentra s.r.o., Company ID 24449237, with its registered office at Zahradní 541, 253 01 Hostivice, Czech Republic, registered with the Municipal Court in Prague, Section C, Insert 441357 (the “operator”). Contact: support@mapino.app, tel. +420 315 315 496.
These terms govern the use of the Mapino platform and the legal relationships between the operator and the users of the service.
Mapino is an online platform for displaying, publishing and highlighting real-estate offers and for related communication between users.
2) Account and access to the service
- Some features are available only after signing in.
- The user is responsible for the security of their account and for the activity carried out through their sign-in.
- It is not permitted to circumvent security, disrupt the operation of the platform, misuse automated access or send spam.
3) The role of the platform
- Mapino is generally not a party to any purchase, lease or other contract between users, agents and prospective parties, unless expressly stated otherwise for a specific service.
- We do not automatically verify the legal status of a property, ownership, the accuracy of the price, availability or the completeness of every piece of information in a listing.
- Before concluding a transaction, the user must independently verify all material facts.
- Rental Management in Mapino is a digital record-keeping and workflow tool for the owner, manager and tenant. On its own it does not replace legal advice, accounting, tax advice, a payment gateway, banking integration or the holding of funds.
- The payment records within Rental Management serve only for the manual recording of expected amounts, due dates, status and settlements. In this part, Mapino does not process payments or provide an accounting service.
- Partner tenant screening is a supporting interface. The partner's output must not be the sole automatic reason for accepting or rejecting a tenant; the final decision must be made by the user responsible for the tenancy relationship.
4) Rules for content and listings
- Submitted content must be truthful, up to date, lawful and must not infringe the rights of third parties.
- The following, in particular, is not permitted:
- impersonating another person,
- posting false, misleading or discriminatory listings,
- infringing copyright, personality or other rights of third parties,
- inserting malware, spam or other abusive technical content.
- If a user acts as an entrepreneur or agent, they are also responsible for fulfilling their statutory information obligations and for a truthful indication of their role.
5) Photographs, videos and documents
- Photographs and videos must depict the actual property being offered.
- The following, in particular, are prohibited: stock photographs, photographs of another property and misleading visualisations.
- Visualisations or AI renders must be clearly marked.
- An active listing may require a minimum number of photographs according to the current platform rules.
- By submitting content, you grant Mapino a non-exclusive, royalty-free, territorially unlimited licence to the extent necessary for operating the service, moderation, display, indexing, technical processing, creating previews, compression, resizing and the possible use of a permitted watermark. The licence lasts for the period the content is displayed and for a reasonable archival period necessary for backups, handling disputes and fulfilling legal obligations.
6) Reviews, chat, reporting and moderation
- Reviews must be based on a real experience and must not be misleading, offensive or unlawful.
- Chat, reports and other communication may be processed for security, abuse prevention, support and the handling of requests.
- Unlawful content, infringements of rights or manifestly misleading listings can be reported to support@mapino.app.
- The operator may hide, restrict or remove content without prior notice and may restrict an account where necessary to protect the platform, other users or to fulfil legal obligations.
- If you disagree with a moderation action, you may request a review at support@mapino.app.
7) Paid services and the order of offers
- The platform may offer paid digital services, in particular listing highlights, boosts or regional highlighting with a
TOP badge, where such services are available in the interface or price list. - Where a plan is identified in the order as an automatically renewing subscription, it renews every 30 days at the stated price after the user's explicit confirmation. Automatic renewal can be turned off in account settings; doing so does not affect an already paid period.
- A paid highlight improves visibility according to the rules of the specific service, but on its own does not guarantee the conclusion of a transaction, a number of views, leads or a fixed position, unless expressly stated.
- The baseline order supplied by the server is based primarily on the most recent update and publication of the listing. For a limited time, an active paid boost adds a time bonus and may therefore move a listing higher; it does not purchase a fixed position.
- In the recommended list for a selected region, an active paid regional highlight may be shown before other listings; where several such listings exist, the start of the highlight and then the baseline order decide. The interface identifies the highlight as paid.
- If the user selects their own sort (for example newest, price, area or price per area), that selected parameter controls the order and a paid regional highlight does not by itself override it.
- Mapino Fresh places actively boosted listings before other listings and orders the rest by publication date. Similar-listing recommendations are based in particular on transaction and property type, subtype and layout, location and distance, similarity of price and area, listing characteristics and the criterion selected by the user.
- The relative importance of the parameters follows their order and purpose described above. We do not disclose exact technical coefficients where doing so would enable abuse or manipulation. A material change to the main parameters will be reflected in these terms and the relevant interface.
7.1) Business users of the platform
- A user offering property or services in the course of business must truthfully identify their business status and provide the identification and contact information required by law.
- Additional rules for business users, including restriction and termination, change notices, data access, ranking and complaint handling, are set out in the Annex for business users of the online platform, which forms part of these Terms.
8) Order, delivery and withdrawal
- The terms of ordering, payments, delivery, complaints and refunds are also governed by the Delivery and Payment Terms and the Complaints Policy documents.
- If an ongoing digital service is to begin before the fourteen-day withdrawal period expires, before the order is concluded we ask the consumer for a separate express request that the service begin immediately. If the consumer withdraws within that period, they pay only the proportionate part of the agreed price corresponding to the service provided up to withdrawal.
- The right of withdrawal may expire before the fourteen-day period ends only if the service has been provided in full during that period and all statutory conditions have been met, in particular the consumer's prior express consent and acknowledgement that the right of withdrawal will be lost. Merely starting an ongoing service does not cancel the right of withdrawal.
9) Liability
- We are liable for the service to the extent set by the applicable law. Nothing in these terms excludes or limits consumer rights that cannot be contractually excluded.
- We are not liable for content submitted by users, the conduct of third parties, the availability of external services, or for whether a transaction between users is concluded or duly performed.
- If a user causes damage by breaching these terms or the rights of third parties, we may claim compensation from them to the extent set by the applicable law.
10) Changes to the service and the terms
- We may reasonably change the service and these terms where necessary due to product development, changes in legal regulations, security or operation.
- The current version is always published on the Mapino website with the date of the last update.
- The notice rules and periods in the Annex for business users of the online platform take precedence for business users.
11) Governing law and dispute resolution
- These terms are governed by the law of the Czech Republic.
- A consumer has the right to out-of-court dispute resolution through the Czech Trade Inspection Authority; details are given in the Complaints Policy.
