Terms for business users (P2B)

1) Scope and relationship to the Terms
This Annex governs the relationship between the operator of Mapino, Nolentra s.r.o., Company ID 24449237, registered office at Zahradní 541, 253 01 Hostivice, Czech Republic, registered with the Municipal Court in Prague, Section C, File 441357 (the “operator”), and a user offering real estate or related services to consumers through Mapino as part of its business (a “business user”).
It forms part of the General Terms and Conditions and prevails for the business-user relationship in the event of a conflict. It reflects Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services (P2B).
2) Service and business-user information
- Mapino enables users, within the functions currently available, to create, manage, publish and promote real-estate listings and communicate with interested parties.
- A business user must accurately disclose its business status and keep the legally required identification, contact, authority-to-list and consumer information current.
- The feature, price, duration and any automatic renewal of a paid service are binding only as displayed and confirmed in the order.
3) Main ranking parameters and paid influence
- Server-provided baseline ranking mainly reflects when a listing was last updated and published. A time-limited paid boost adds a recency bonus and may move a listing higher; it does not buy a fixed position.
- In a recommended list for a selected region, an active paid regional promotion may appear ahead of other listings. Among promoted listings, the start of the promotion and then the baseline ranking decide. Paid influence is labelled in the interface.
- If a user selects their own sorting, such as date, price, area or price per area, that choice controls and regional promotion does not override it by itself.
- Mapino Fresh places actively boosted listings first and otherwise sorts by publication date. Similar-listing recommendations mainly consider transaction and property type, subtype and layout, location and distance, price and area similarity, listing attributes and the perspective selected by the user.
- The parameters above carry more weight than auxiliary technical signals. Exact coefficients are withheld only to the extent disclosure would enable fraud or manipulation. A material change to the main parameters is notified under section 8.
4) Own offers and differentiated treatment
- The operator currently offers no own real-estate listings, or listings of a controlled business user, that receive preferential ranking over other business users.
- Mapino's own digital products, such as subscriptions, boosts or regional promotions, may appear in separate interface areas. They are not real-estate listings competing in listing rankings.
- Before introducing preferential legal, commercial or technical treatment of own or controlled real-estate offers, the operator will describe its nature and reasons in this Annex.
5) Access to data
- While the account is active, the business user can access the data, content, messages and statistics that the current interface exposes for its own account and listings. Available statistics depend on the active plan and functions.
- The operator can access data supplied by the business user and data generated by the service, including account, listing, order, payment, communication, impression, response, security and feature-usage data. It uses them to provide, secure, support, bill, measure and improve the service and meet legal obligations as described in the Privacy Policy.
- The business user has no access to non-public data of other users, source data, internal security signals or the operator's trade secrets. It receives an interested person's contact details only where that person discloses them through a service function or another legal basis exists.
- Categories of recipients and processors are described in the Privacy Policy. A business user cannot opt out of transfers necessary to provide an ordered service, secure the platform, process payment or meet a legal obligation.
- Ordinary interface access ends when the account ends. Before termination, the business user should download any data the interface permits it to export. Where no self-service export exists, it may request a reasonable copy of its own data at support@mapino.app before termination, subject to others' rights, security, trade secrets and legal duties. Retention periods and personal-data rights are governed by the Privacy Policy and applicable law.
6) Restriction and suspension
The operator may restrict a listing's visibility or a feature, or temporarily suspend an account, in particular because of:
- breach of the Terms, this Annex, rules of a paid service or applicable law;
- unlawful, false, misleading, discriminatory, duplicate or spam content;
- infringement of intellectual property, privacy or other third-party rights;
- false or incomplete business, authority-to-list or property information;
- an overdue amount, payment abuse, chargeback or reasonable suspicion of fraud;
- risk to an account, the platform, data or other users, abusive automation or circumvention of technical controls;
- repeated or serious breach of quality or content rules disclosed in the interface; or
- an enforceable decision, public-authority order or other legal obligation.
Where legally and securely possible, we state the specific facts and contractual or legal ground on a durable medium before the measure or no later than when it takes effect, normally by email or an account message. The business user may clarify the matter under section 11. If the measure is revoked, we restore the affected service without undue delay unless another ground prevents it.
7) Termination of the entire service
- We may terminate the entire service for a ground in section 6, long-term inactivity after notice, discontinuation of the relevant service or business line, or at the business user's request.
- An operator decision to terminate the entire service is provided, with reasons on a durable medium, at least 30 days before it takes effect.
- The 30-day period does not apply where a legal or regulatory obligation requires termination, an imperative reason under law exists, or we can demonstrate repeated infringement of the Terms. We then provide reasons without undue delay and no later than termination takes effect, unless law prohibits disclosure or it would compromise an investigation or security.
- The business user may seek clarification or review under section 11. If the decision is reversed, we restore the account and relevant data access without undue delay where technically possible and not prevented by law or security.
8) Changes to terms
- A proposed change to the Terms or this Annex is notified to the business user on a durable medium at least 15 days before it takes effect. We allow more time if the change requires disproportionately complex technical or commercial adaptation.
- The business user may terminate during the notice period. Continued use does not waive the notice period before it expires. A waiver is valid only by an express written statement or unambiguous affirmative action where permitted by law.
- Prior notice is not required where a legal or regulatory obligation prevents the 15-day period or an unforeseen and imminent threat requires action, especially fraud, malware, spam, a data breach or cyber risk.
- Changes are not applied retroactively unless required by law or demonstrably beneficial to the business user.
9) Other distribution channels
Mapino does not generally prevent a business user from offering the same property or service through other online or offline channels, including on different terms. This does not permit evading payment for a Mapino digital service already ordered, using contact functions for spam or infringing third-party rights.
10) Intellectual property
- The business user retains its rights in submitted content and grants the operator only the non-exclusive licence described in the Terms and necessary to operate, display, distribute, technically process, secure and promote the particular listing and platform.
- On termination, use for new public displays ends, except for reasonable retention in backups, evidence, accounting or audit records and use required by law or needed to resolve a dispute.
- Mapino grants no licence to source code, trade marks, databases, map data or third-party content beyond ordinary interface use.
11) Internal P2B complaint handling
A business user may lodge a complaint free of charge, in particular about an alleged operator compliance failure, technical issue, moderation, ranking, restriction, suspension or termination.
- Email support@mapino.app with the subject “P2B complaint”. Include the account email, listing or decision identifier, problem, requested outcome and available evidence. Do not send unnecessary personal data or passwords.
- We acknowledge receipt without undue delay on a durable medium and assign a reference. Support is the intake channel; an automatic reply does not decide the complaint.
- A person able to review, or procure review of, the affected decision assesses the complaint individually and proportionately and allows material facts to be supplemented.
- We communicate the outcome, main reasons and any remedy on a durable medium and retain proportionate records of handling and outcome under the Privacy Policy.
This process does not replace the DSA notice and appeal mechanism, a consumer complaint, or the right to approach a court or authority.
Article 11(5) exempts a provider that is a small enterprise within the Annex to Recommendation 2003/361/EC. Mapino offers this process voluntarily even where that exemption applies. Team size or a startup label alone does not prove the exemption: before relying on it, the operator must document headcount, turnover or balance-sheet total and linked/partner enterprises. Until approved, this process is not presented as proof of an exemption or as verified Article 11(4) effectiveness statistics.
12) Mediation
If the internal process does not resolve a dispute, the parties may agree in writing to voluntary mediation. The operator has not yet identified in this Annex at least two specific mediators under Article 12 of Regulation (EU) 2019/1150. Article 12(7) exempts a small enterprise within Recommendation 2003/361/EC, but reliance on it requires the approved assessment described above. Without that assessment or at least two named suitable mediators, this text must not be treated as satisfying Article 12(1). Judicial remedies and voluntary agreement on a specific mediation remain unaffected.
